Who is responsible for window mold?« Back to Previous Page

After the heavy rains last month, I noticed a musty smell coming from the corner of the living room near the window. My landlord said it was probably mold water seeping in from outside, but I’m not sure if that’s his responsibility to fix or mine. Have any of you experienced something similar and know what might be expected regarding maintenance in such cases?

In the UAE, particularly in Dubai, mold issues can arise from heavy rainfall. The scenario you've described is indeed common following such weather events. It's crucial to understand that the responsibility for addressing water seepage and mold growth often depends on the type of property ownership and the specific conditions.

For residential properties, if the window or any external wall is a shared structure with your neighbor, the maintenance responsibility might fall under the condominium association or building management company as per UAE laws. However, in cases where the damage is due to external factors beyond the control of residents, such as leaks from neighboring units or public infrastructure issues, these are generally not the tenant's responsibility.

In commercial properties, landlords typically bear a higher burden for maintaining structures and addressing water-related issues. Nonetheless, it’s always wise to review your lease agreement to determine specific responsibilities.

Given the recent rains, you should conduct an inspection to confirm if there is indeed mold growth or just a musty smell which could be from other factors like dampness without active mold colonization. If confirmed as mold, professional remediation would be recommended due to health concerns and legal requirements in Dubai.

The UAE Building Control Regulations (BRC 2016) mandate the control of moisture sources and the prevention of water penetration into buildings. Mold growth can indicate a serious moisture problem that could compromise structural integrity if left unchecked.
