Who is responsible for AC leak and mold in rental?« Back to Previous Page

The AC unit in my bedroom in my Jumeirah Village rental has been leaking a bit, and now I’ve found black spots spreading along the bottom of the wall behind the wardrobe. My landlord is saying it’s a maintenance issue for me to handle since it’s inside the apartment, but isn’t the AC itself his responsibility? Who is actually liable for the mold cleanup and repair in this situation?

Based on UAE rental law, specifically Law No. (26) of 2007, the landlord is generally responsible for the maintenance of the main structural components of the property, including the central air conditioning system and the building envelope. An AC unit leaking inside the apartment is a failure of the fixture itself, making it the landlord's responsibility to repair.

However, the resulting mold on the wall is a separate issue that can become complicated. While the landlord must fix the source leak, tenant liability for the mold cleanup can depend on whether you reported the leak in a timely manner. If you delayed reporting it, leading to significant mold growth, you could be held partially responsible for the remediation of the affected area.

That black spotting behind the wardrobe is a major concern. It indicates sustained moisture and the potential for more extensive hidden growth. DIY cleaning with bleach is highly inadvisable; it only bleaches the surface and doesn't kill the roots, and the moisture will cause it to return quickly. This requires professional assessment.

You need a certified mold inspection to determine the full extent of the contamination, identify the exact species (some are more hazardous than others), and provide a official report. This report is crucial evidence to formally present to your landlord, outlining the necessary professional remediation steps.

Do not attempt to handle this yourself. For an immediate professional assessment and detailed report to resolve the liability issue, call our experts at 800-MOLDS or email hello@saniservice.com.
