Who is responsible for air conditioner repair, tenant or landlord?« Back to Previous Page

My landlord is insisting I pay for the living room AC repair, which started making a loud grinding noise a few days ago. We’ve been in this Jumeirah Village Circle apartment for almost three years, and the unit looks original to the building. Who is actually responsible for getting a certified technician here to fix this, me or the owner?

Based on the Dubai Rental Law (Law No. 26 of 2007) and the standard tenancy contract, the responsibility for AC repair is typically on the landlord, especially for units that are original to the building and constitute a permanent fixture. The key factor is whether the issue is due to normal wear and tear or tenant misuse.

Since you've been in the apartment for three years and the unit is original, that grinding noise is a classic symptom of a failing compressor or a worn-out fan motor, both of which are results of natural deterioration. This falls squarely under maintenance for wear and tear, which is the owner's financial and legal obligation. They are responsible for providing a habitable premises, which includes a functional climate control system. They must arrange and pay for a certified technician to diagnose and repair the unit.

Do not proceed with hiring your own technician, as this could inadvertently void any existing maintenance contracts and make you liable for the cost. formally notify your landlord in writing (email is best for a paper trail) of the issue, referencing your tenancy contract and the relevant law. Insist that they send a certified HVAC professional to assess it.

For a comprehensive indoor air quality assessment to ensure the malfunctioning unit hasn't led to mold growth from potential moisture issues, a professional inspection is highly recommended.
