Who is responsible for mold from parking flood?« Back to Previous Page

Our building's underground parking in Jumeirah Lake Towers was completely flooded during the storm last week and the dampness has crept up the walls into our ground-floor apartment. I’ve started seeing patches of mold on the bottom of the wardrobe where we store our clothes and the carpet in the living room still feels slightly wet. Who is responsible for the mold remediation and repairs, me as the tenant or is the landlord required to handle this?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for maintaining the property's structural integrity and addressing issues that affect its habitability. A flood event of this magnitude, originating from the building's common areas (underground parking), is not due to tenant negligence but rather a building maintenance and waterproofing failure.

The seepage of dampness through the foundation and walls is a structural defect. The resulting mold growth is a direct consequence of this failure in the landlord's obligation to provide a habitable premises. You should formally notify your landlord or property management company in writing immediately, detailing the issue and including photographs of the mold and damp patches. They are obligated to arrange for professional water extraction, structural drying, and mold remediation to prevent further damage and health risks.

However, your contents, such as the carpet and items in the wardrobe, may fall under your purview as the tenant, so check your tenancy contract for specific clauses regarding contents insurance.

Given the severity you've described—ongoing dampness and active mold growth—this is a serious case requiring immediate professional assessment. The moisture trapped within the building structure requires specialized equipment like dehumidifiers and moisture meters to properly address. DIY attempts often fail to solve the hidden problem, leading to recurrent mold.

For a certified inspection and comprehensive remediation plan, it's crucial to call experts. You can reach our team at 800-MOLDS or 800-66537 for an immediate assessment. We can also provide a detailed report to support your communication with the landlord.
