Tenant or landlord responsible for black mold remediation?« Back to Previous Page

We’ve lived in our Jumeirah apartment for 2 years and just noticed a patch of black mold in the corner behind the wardrobe in our main bedroom. It’s been extra humid the last month and the musty smell is really strong in that room, even with the AC running constantly. Since we're tenants, are we responsible for cleaning this ourselves, or is the landlord supposed to handle mold prevention and remediation?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the responsibility for mold remediation is typically determined by the source of the moisture issue. The landlord is legally obligated to provide a habitable property, which includes maintaining the structural integrity of the building. If the black mold behind your wardrobe is a result of a structural problem, such as a leaking pipe within the walls, a crack in the building envelope, or faulty external waterproofing that is allowing moisture ingress, then the remediation is unequivocally the landlord's financial and logistical responsibility.
However, as a tenant, you are responsible for maintaining the property in a hygienic condition and ensuring adequate ventilation. If the mold growth is determined to be solely due to lifestyle factors—like insufficient use of the AC, drying clothes indoors, or blocking ventilation grilles—you could be held liable for the cost of cleanup. Given your location in Jumeirah and the persistent humidity, the constant AC use suggests a deeper issue. The placement behind a large piece of furniture is a classic sign of poor air circulation and a potential cold spot, but the strong musty smell indicates a significant infestation that likely requires professional assessment. We strongly advise against attempting to clean this yourself, as improper remediation can aerosolize spores and exacerbate the problem. A certified inspection is crucial to identify the exact moisture source and assign liability correctly.
