Is black mold a tenant or landlord responsibility?« Back to Previous Page

We've lived in our Marina apartment for two years and just noticed a bunch of black spots growing along the bottom of the wall behind our sofa. It's been extra humid lately and I'm worried it's spreading. As a tenant, am I responsible for cleaning this myself, or is this the kind of thing the building management or landlord needs to handle and pay for?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the responsibility for mold remediation depends on the source of the moisture. As a certified mold inspector in Dubai, here's the breakdown:

The landlord is legally obligated to maintain the property's structural integrity. If the mold is a result of a structural issue—such as a leaking pipe within the walls, faulty waterproofing on the exterior, or a leaking AC condensation line from the building's central system—then the repair and subsequent mold remediation are the landlord's financial responsibility. You described the mold behind a sofa on an exterior wall; this is a classic sign of condensation due to poor insulation (a building issue) or a hidden leak.

However, if the moisture source is determined to be tenant-related, like excessive indoor humidity from not using the AC, drying clothes indoors, or lack of ventilation, then the cost of cleaning may fall to you. The humid climate in Marina makes proper AC operation crucial for moisture control.

Do not attempt to clean it yourself. Disturbing mold can aerosolize spores and spread the contamination. Your first step is to formally notify your landlord and building management in writing, with photos, requesting an investigation into the moisture source. For a definitive assessment and a report that can be used to establish liability, a professional inspection is essential. We can identify the species and the exact cause.
