Is my landlord responsible for closet mold in my rental?« Back to Previous Page

The ceiling in our master bedroom closet in our Jumeirah Village Triangle apartment has developed a bunch of black mold spots, and it's definitely gotten worse since the heavy dew we had last week. We've been in this rental for about a year and never had an issue before. Is fixing this the responsibility of my landlord, or am I expected to handle the cleaning and repairs myself?

Based on the UAE Civil Code, particularly Article 15 of Law No. 26 of 2007, the landlord is generally responsible for maintaining the structural integrity of the property, which includes addressing issues that affect the habitability of the unit. This typically extends to problems like mold growth resulting from a structural defect, such as a leaking roof, faulty AC drainage, or poor insulation that leads to condensation.
The persistent heavy dew you mentioned in JVC is a key factor. This high humidity, combined with a potential lack of ventilation in the closet, creates the perfect environment for mold. If the root cause is a pre-existing structural issue (e.g., a hidden leak from the roof or a neighboring apartment), the onus is on the landlord to rectify it. You should notify them in writing immediately, as delays can exacerbate the problem and potential health risks. However, responsibility can shift if the mold is determined to be a direct result of tenant negligence, such as a lack of ventilation or failure to use the AC to control humidity, though this is less common with ceiling growth. Given that it's a significant and worsening issue, we strongly recommend a professional inspection to identify the precise moisture source. Our certified inspectors can conduct air and surface sampling to identify the mold type and, crucially, use thermal imaging and moisture meters to pinpoint the exact cause. This detailed report is essential for determining liability and ensuring the remediation addresses the root problem, not just the visible spots.
