Is landlord responsible for AC mold causing child's cough?« Back to Previous Page

My kids have been coughing more than usual and I suspect it's because of the black mold that's forming around the AC vent in our master bedroom. It’s been spreading since the humidity kicked in a few weeks back. I've told the landlord twice, but they just sent a handyman who wiped it down and didn't fix the actual problem. Are we, as tenants, responsible for getting this professionally cleaned, or is it the building's obligation to fix the AC unit that's causing the condensation?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is unequivocally responsible for maintaining the structural integrity of the property, which includes the proper functioning of all major installed systems like the AC unit. The recurring mold growth around your AC vent is a direct symptom of an underlying issue, most likely excessive condensation due to poor insulation, a clogged drain line, or a malfunctioning unit.

Your landlord's handyman merely wiped the surface, which is a temporary and completely inadequate solution. The mycotoxins from the black mold (likely Stachybotrys or Aspergillus) are a known respiratory irritant and are almost certainly contributing to your child's persistent cough. This is a health and safety issue.

You are not responsible for the professional remediation of this problem. I strongly recommend you formally notify your landlord in writing, perhaps via registered mail or email, stating that the superficial cleaning was insufficient and demand a professional inspection and permanent fix for the AC unit to prevent further mold growth.

For your family's health, a professional indoor environmental inspection is crucial to assess the spore count in the air and the full extent of contamination. We can provide a comprehensive assessment and a legally valid report for your landlord. Please call us at 800-MOLDS or email hello@saniservice.com to schedule an inspection.
