Is mold in my rental apartment the landlord's responsibility?« Back to Previous Page

The wall behind our sofa in the living room has started getting these black, fuzzy patches, and it's definitely gotten worse since the heavy humidity last week. We've lived in this Marina apartment for about a year and never had this issue before. I'm worried it's making my allergies act up. Who is responsible for getting this tested and properly removed – me as the tenant, or is this the building management's job?

This is an excellent and very common question, especially given the high humidity levels we experience here in Dubai. Based on your description of fuzzy black patches worsening after a humidity spike, this is highly likely a mold colony that requires professional attention.

In the UAE, the responsibility for mold remediation in a rental property is typically determined by the source of the moisture. According to standard tenancy contract terms and Dubai Law No. 26 of 2007 (as amended), the landlord is responsible for maintaining the property's structural integrity. This includes addressing issues like leaking pipes, faulty AC drainage, or cracks in the building envelope that allow moisture ingress – which are the most common causes of mold in Marina apartments.

Your responsibility as the tenant generally covers moisture generated from inside the apartment due to daily living (like cooking or showering without proper ventilation) and for promptly reporting any signs of dampness or leaks to the landlord or building management. Since this appeared suddenly behind a sofa, it could be a hidden pipe leak or a cold spot on the wall causing condensation, both of which are structural and fall under the landlord's purview.

Your first step is to immediately notify your landlord and building management in writing, including photos. They have an obligation to investigate and rectify the source of the moisture. Do not attempt to clean significant mold growth yourself, as improper handling can aerosolize spores and worsen contamination and health effects, like the allergies you're experiencing.

For a definitive assessment and to establish responsibility, a professional mold inspection is crucial. We can identify the species, the extent of the contamination, and most importantly, the precise moisture source. This report is often necessary to formally resolve liability with the landlord.

Given the potential health risks and complexity of UAE tenancy laws, we strongly recommend a certified inspection. Call us at 800-MOLDS (800-66537) or email hello@saniservice.com for a thorough assessment and to ensure the remediation is handled safely and effectively.
