Is landlord responsible for black mold in Dubai apartment?« Back to Previous Page
|
We've lived in our Jumeirah Village Circle apartment for 2 years and just noticed a huge patch of black mold spreading from the corner of our master bedroom closet. The dehumidifier is always running, but it's gotten much worse since the heavy rains last month. Am I responsible for the cleaning and repairs, or is my landlord legally required to handle this since it's a structural issue?

This is a very common and serious issue we see in Dubai, especially after periods of high humidity and rain like we had recently. The short answer is: it depends on the root cause, but the landlord is very often responsible.
Under UAE law, specifically Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai (as amended), the landlord is legally obligated to maintain the property to ensure it is habitable. This includes addressing structural defects that lead to moisture intrusion. A black mold patch spreading from a closet corner is a major red flag for a hidden leak or insufficient insulation in the building envelope—which are structural issues. Your obligation as a tenant is typically limited to general maintenance and reporting the issue promptly, which you have done. However, if the cause is determined to be tenant negligence—like a spill that wasn't dried or blocking the AC vents—you could be held liable. That said, given the location and the fact your dehumidifier is running, a structural cause is highly probable. Stop: Do not attempt to clean significant black mold yourself. Disturbing it releases toxic spores. This requires professional containment and remediation. You must formally notify your landlord/property management in writing immediately. They should arrange for a professional mold inspection. We use thermal imaging and moisture meters to pinpoint the exact moisture source, which is critical for determining liability. If they are unresponsive, you can file a complaint with the Rental Dispute Center (RDC) in Dubai. For a proper assessment and to protect your health, get a certified expert to investigate. Call us at 800-MOLDS (800-66537) or email hello@saniservice.com for an immediate consultation. We can provide the official report you need to resolve the liability issue with your landlord. |
