The paint on the ceiling of my master bedroom in our Jumeirah apartment has started to peel and bubble in a large patch, and I'm worried about a possible leak from the apartment above. We noticed it getting worse over the last couple of weeks. According to Dubai municipality housing rules, is this kind of internal damage from a potential leak the responsibility of me as the tenant, or is the building owner required to fix it?

Based on the Dubai Rental Law (Law No. 26 of 2007) and the standard tenancy contract stipulations, the responsibility for structural repairs like a ceiling leak typically falls on the landlord or building owner, not the tenant.
The law distinguishes between minor maintenance and major structural repairs. As a tenant, you are generally responsible for minor upkeep and repairs resulting from daily use. However, a leaking ceiling is considered a fundamental issue with the property's structure and envelope, which is the landlord's legal obligation to maintain and rectify. This is especially true if the leak originates from a common area or another unit, like the apartment above yours. The building owner is responsible for ensuring the integrity of the building's infrastructure. Your first step is to immediately notify your landlord and building management in writing, detailing the issue with photos. They are obligated to investigate the source, often from the unit above or a cracked internal pipe, and carry out the necessary repairs. Document all communication. If they are unresponsive, you can file a formal complaint with the Rental Dispute Settlement Center (RDSC) in Dubai.
