Is landlord or tenant responsible for mold cleanup?« Back to Previous Page

Our master bedroom closet has started to have a strong, damp smell, and I just found black spots on the back wall and some of our shoes. It's been like this since the humidity really spiked a few weeks ago, and we're in an older building in Jumeirah. Who is responsible for getting this professionally cleaned and paying for it—me as the tenant or my landlord?

Based on UAE law, specifically Article 17 of Law No. 26 of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai (as amended), the responsibility for mold cleanup is generally determined by the source of the moisture.
The landlord is legally obligated to maintain the property in a condition that is habitable. This includes the structural integrity of the building. Therefore, if the mold is a result of a structural issue—like a leaking pipe within the walls, a faulty AC condensation drain line, water seepage from the building envelope, or a roof leak—the remediation cost falls squarely on the landlord. Given you're in an older Jumeirah building and the issue coincided with high humidity, a persistent condensation problem due to inadequate insulation or a hidden leak is a strong possibility. However, the tenant is responsible for damages resulting from their own negligence or misuse of the property. If the mold is conclusively proven to be caused by your actions, such as a failure to use the provided ventilation systems, blocking AC vents with stored items, or introducing excessive moisture without proper mitigation, you could be held liable for the cleanup costs. The critical first step is a professional inspection to identify the exact moisture source. Our certified mold assessors use thermal imaging, moisture meters, and borescopes to pinpoint the origin without destructive testing. This evidence is crucial for determining liability. We provide a detailed report that can be used to formally communicate with your landlord or building management. For a situation like your closet, with visible growth and a strong odor, this is a serious case requiring professional assessment. Don't attempt to clean it yourself, as improper disturbance can spread spores and exacerbate the problem. Call us at 800-MOLDS (800-66537) or email hello@saniservice.com to schedule an inspection. We'll identify the cause and provide the documentation needed to resolve the responsibility issue with your landlord. |
