Is mold removal my or my landlord's responsibility?« Back to Previous Page

The wall behind the wardrobe in my bedroom in our Jumeirah Village Circle apartment has these black splotches that have been slowly spreading. It’s been humid for the last couple of months and the smell is getting really strong, giving me headaches. Our tenancy contract is a bit vague about repairs. Am I supposed to pay for the mold inspection and removal myself, or is this the landlord's responsibility to fix?

Based on the UAE Civil Code, specifically Law No. (5) of 1985, the responsibility for major structural repairs and maintenance of the property's core components, including the building envelope, plumbing, and electrical systems, falls squarely on the landlord. Mold growth stemming from a hidden leak, rising damp, or inadequate waterproofing is typically considered a structural issue. The landlord is therefore obligated to address the root cause of the moisture.

However, if the moisture issue is a direct result of tenant behavior—such as a failure to use provided ventilation systems, excessively drying clothes indoors without ventilation, or failing to report a minor leak in a timely manner—the remediation costs could potentially be argued as the tenant's responsibility.

In your case at JVC, the description of black splotches spreading behind a wardrobe strongly indicates a persistent humidity or condensation issue, likely exacerbated by the recent weather. This is a common problem where furniture is placed against an exterior wall, creating a cold spot and trapping moisture. The accompanying smell and headaches are significant indicators that professional assessment is crucial. You should not attempt to remove this yourself, as disturbing it can aerosolize harmful spores.

Your first step is to formally notify your landlord or property management company in writing, detailing the issue and including photographs. Clearly request a professional mold inspection to identify the moisture source and extent of contamination. Given the health symptoms, this is urgent. The inspection report will definitively determine liability. For a certified assessment and remediation quote, its best to call professionals.
