Our AC unit in the bedroom has been leaking a little for a couple of months, but after the heavy dew last week, I spotted a big patch of black mold on the wall behind the wardrobe. My landlord says it's because we don't run the AC enough, but we keep it at 24°C when we're home. Who is actually responsible for getting this cleaned and repaired, us or the landlord?

Based on UAE rental law, specifically Law No. 26 of 2007, the responsibility for major maintenance and structural repairs falls squarely on the landlord. This includes issues stemming from the building's infrastructure, such as faulty AC units and the resultant water damage and mold growth you've described. Since the leak is from the AC unit itself, which is a fixture provided with the property, its repair and the remediation of the damage it causes are the landlord's legal obligation.

The landlord's claim that you don't run the AC enough is not a valid defense. In Dubai's climate, AC systems are designed to handle humidity; a properly functioning unit should not leak or cause condensation issues that lead to significant mold growth, regardless of the set temperature. A persistent leak indicates a problem with the drainage line, insulation, or the unit's installation.

Your responsibility as a tenant is limited to minor maintenance and reporting issues promptly, which you have done by informing them of the leak months ago. The appearance of a large patch of black mold, especially Stachybotrys, signifies a serious moisture problem that requires professional remediation. DIY cleaning is not advised as it can disturb toxic spores.

You should formally notify your landlord in writing, reiterating the issue and requesting immediate professional inspection and remediation.
