Is landlord responsible for black mold from leaks?« Back to Previous Page

The ceiling in the corner of our master bedroom in Jumeirah Village Circle has developed a pretty big black mold patch, it’s been slowly spreading since the heavy rains we had in March. The landlord is saying it’s our fault for not ventilating properly, but we run the AC constantly. Are we legally responsible for the cleanup and repairs, or is this on the landlord?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for the structural integrity of the property and for carrying out maintenance work on the main parts of the building, including the roof, walls, and central AC systems. A mold outbreak resulting from water ingress through a leaking ceiling is a structural issue, not an issue of tenant negligence.
Your situation in JVC is a classic case. The heavy rains in March exposed pre-existing or new construction defects that allowed water to penetrate the building envelope. Even if you run the AC, it cannot combat an active water leak from outside. The landlord's claim that improper ventilation is the cause is likely incorrect; while ventilation prevents condensation-related mold, it does not address mold caused by a direct water intrusion event. For a definitive answer, a professional mold inspection is critical. Our certified inspectors can conduct a comprehensive assessment to identify the exact moisture source (e.g., roof leak, cracked facade, faulty sealant) and provide a detailed report that legally distinguishes the cause. This report is essential evidence if you need to dispute the landlord's claim with the Dubai Land Department's Rental Dispute Center. The remediation process must address the root cause—the leak—first, followed by the safe removal of the contaminated materials and hygienization of the area. Do not attempt to remove significant mold growth yourself, as improper handling can exacerbate spore dispersal and health risks. |
