Is landlord responsible for black mold from a leak?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for two years, and just noticed a patch of black mold in the corner of our bedroom closet, right on the wall. It’s been really humid lately and I think it's from a hidden water leak or maybe just condensation. Is this something I need to fix myself, or is the landlord responsible for handling the repair and mold removal?

Based on UAE rental law, specifically Law No. (26) of 2007, the landlord is generally responsible for maintaining the structural integrity of the property. This includes addressing the root cause of any mold, such as repairing hidden water leaks, faulty plumbing, or issues with the building's external envelope that allow moisture ingress. The presence of black mold (likely Stachybotrys chartarum) stemming from a concealed leak falls squarely under their obligation to provide a habitable dwelling.

However, the tenant is responsible for general upkeep and ventilation. If the mold is solely due to a lack of air circulation and condensation from activities like drying clothes indoors without using an AC/dehumidifier, the remediation cost could fall on you.

Given your location in JVC and the recent high humidity, a professional inspection is critical to determine the exact moisture source. We use thermal imaging cameras and moisture meters to pinpoint leaks that are not visible to the naked eye. Attempting a DIY fix on black mold is not advised due to health risks and the high probability of recurrence if the moisture source isn't professionally identified and remediated.

Your first step is to formally notify your landlord or property management company in writing about the issue, as they are obligated to investigate and fix the leak.
