Who pays for mold remediation, tenant or landlord?« Back to Previous Page

The AC in my bedroom closet has been leaking a little, and now there's a large patch of black mold spreading on the wall. I told my landlord in Al Barsha about it a month ago, but they just sent a handyman who wiped it with bleach and it's already come back worse. With this humidity, I'm worried it's getting out of hand. Who is legally responsible for paying for proper mold remediation, me or the landlord?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is typically responsible for all major maintenance and repairs related to the structural integrity of the property and its core systems, including the AC and resulting water damage. This is considered part of their obligation to provide a habitable premises.
The key factor here is the source of the moisture. Since the mold growth is a direct result of a leaking AC unit—a fixture provided by the landlord—the financial responsibility for the proper remediation falls on them. Their attempt to fix it with bleach was inadequate; bleach only removes surface discoloration and does not address the root moisture problem or kill the mold roots (hyphae) embedded in the wall. This is why it has returned more aggressively. You should formally notify your landlord in writing (email is best for a paper trail) that the temporary fix has failed and the biological contamination has worsened. Clearly state that professional remediation is now required to protect the property's structure and indoor air quality, referencing your initial report from a month ago. For a case of this size and cause, we strongly recommend a professional inspection and remediation quote. DIY or handyman solutions are not sufficient and can cause cross-contamination. Our certified teams use EPA-approved protocols, including containment, HEPA filtration, and antimicrobial treatments, to safely remove the infestation and identify the exact point of the AC leak. Feel free to call us at 800-MOLDS (800-66537) for an assessment. We can provide a detailed report you can submit to your landlord, outlining the cause and the necessary scope of work, which often helps expedite the process. |
