Who is responsible for AC mold in a rental property?« Back to Previous Page

The AC in my bedroom has been leaking a little onto the carpet for a couple of months, and now I’m seeing some black speckles spreading out from the vent. My landlord says it’s just dirt and to clean it, but I’m worried it’s mold, especially with the humidity. Who is actually responsible for getting this tested and fixed in a rental, me or the property owner?

Based on the description of a long-term leak and visible black speckling, there is a very high probability this is indeed mold growth, not just dirt. The constant moisture from an AC leak, combined with our high UAE humidity, creates the perfect breeding ground for mold, particularly the common black mold, Stachybotrys or Aspergillus.
Under Dubai/UAE rental law (Law No. 26 of 2007), the responsibility for maintenance of major structural elements and essential services, including the central air conditioning system and its components, falls squarely on the property owner or landlord. This is considered a fundamental obligation to provide a habitable property. The tenant's responsibility is typically for minor internal maintenance and general cleanliness. Your landlord's dismissal is a common but incorrect response. Dirt does not spread from a consistent moisture source; microbial growth does. You should formally notify your landlord in writing (email is best for a paper trail) of the issue, stating the AC leak and suspected mold growth. Request immediate professional inspection and remediation. Do not attempt to clean it yourself, as improper disturbance can aerosolize spores and worsen contamination. For a definitive assessment and legal standing, I strongly recommend a professional indoor environmental inspection. We provide certified mold testing to identify the species and concentration levels, which provides the evidence needed to compel your landlord to act responsibly. If they remain uncooperative, you can escalate the matter to the Rental Dispute Center (RDC) in Dubai.
