Is landlord responsible for mold in Jumeirah apartment?« Back to Previous Page
|
We've lived in our Jumeirah apartment for 2 years and just noticed a bunch of black spots growing along the wall behind our bedroom wardrobe. It’s been extra humid the last few weeks and I think it’s finally taken its toll. Is it my landlord's responsibility to fix this and pay for the remediation, or is this on me?

Based on UAE law, specifically Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai, the responsibility for mold remediation hinges on the cause of the moisture.
The landlord is legally obligated to maintain the property's structural integrity and ensure it is habitable. Therefore, if the mold is a result of a structural issue like a leaking pipe within the walls, a faulty AC drainage system, water seepage from the building envelope, or inadequate waterproofing, the repair and subsequent mold remediation are unequivocally the landlord's financial and legal responsibility. However, if the moisture source is determined to be tenant-related, such as insufficient ventilation (e.g., not using exhaust fans, keeping windows constantly closed), drying clothes indoors, or failing to properly operate the air conditioning to control humidity, then the cost of remediation would likely fall to you, the tenant. Given that the mold is behind a wardrobe—a classic spot for poor air circulation—the cause could be a combination of factors. The recent high humidity exacerbates the problem, but the root cause needs professional diagnosis. We strongly recommend a certified mold inspection to identify the exact moisture source and type of mold. Our technicians use thermal imaging cameras and moisture meters to pinpoint leaks and condensation issues that are not visible to the naked eye. This objective report is crucial for determining liability with your landlord.
