As tenants, is mold inspection our or landlord's responsibility?« Back to Previous Page

We've lived in our Jumeirah villa for 2 years and just noticed a patch of black mold spreading in the closet of our master bedroom, which is on the outer wall. With all the humidity lately, it’s gotten worse and has a really strong, damp smell. As tenants, are we responsible for paying for a professional mold inspection, or is that something the landlord has to handle?

In the UAE, the responsibility for mold inspection and remediation is primarily governed by the rental contract and Dubai Law No. 26 of 2007, as amended (the 'Dubai Rental Law'). Typically, structural issues and problems inherent to the property itself are the landlord's responsibility. Given that the mold in your Jumeirah villa is on an outer wall and has developed over time, it is highly likely caused by a structural defect, such as water infiltration through the wall or a faulty external waterproofing membrane. This type of pervasive issue, exacerbated by our high humidity and constant AC operation leading to condensation, falls under the landlord's obligation to rectify.

As a tenant, your responsibility is to report the issue to the landlord or property management company in writing immediately. Prompt reporting is critical to prevent further damage and to establish a timeline. However, if the mold growth is a direct result of tenant negligence, such as a failure to use the AC to control humidity or not reporting a water leak in a timely manner, you could be held liable.

For a case like yours—a spreading patch with a strong, damp odor—a professional inspection is non-negotiable. DIY assessments are insufficient as they miss hidden mold and the root cause. A certified inspector will conduct moisture mapping, thermal imaging, and air quality testing to identify the exact source of moisture and the extent of contamination. This detailed report is essential to compel the landlord to act and to guide the proper remediation protocol.
