Who pays for mold removal in Dubai rental?« Back to Previous Page

The AC in my apartment seems to be leaking a bit, and now I’ve found a patch of black mold in the corner of my bedroom closet. My landlord is saying it’s because I don’t ventilate the room properly, but I run the AC constantly and it’s been incredibly humid lately. Who is actually responsible for paying for the mold removal in a rental here in Dubai, the tenant or the landlord?

In Dubai's rental sector, responsibility for mold removal is typically determined by the source of the moisture, as outlined in Law No. 26 of 2007, known as the Dubai Rental Law. The landlord is responsible for the property's structural integrity and maintenance of major systems, including the AC unit and its drainage. If the mold is a direct result of an AC leak, as you've described, the financial responsibility for remediation almost certainly falls on the landlord. Their claim about improper ventilation is a common deflection, but given our climate of high humidity and the necessity of year-round AC use, condensation and leaks from poorly maintained units are a leading cause of microbial growth and are not the tenant's fault.

However, a professional inspection is critical to establish causation definitively. A certified mold assessor can identify the moisture source, confirm the mold type, and provide a detailed report. This report is vital evidence if a dispute with the landlord arises, as it provides an expert opinion on the root cause. Attempting removal without identifying and rectifying the source is a temporary fix.

We can conduct a comprehensive inspection, including air and surface sampling, to document the issue and its cause.
