Is landlord or tenant responsible for AC mold?« Back to Previous Page

The AC in my apartment seems to be leaking a bit of water onto the carpet in the master bedroom closet, and now I’ve found a patch of black, fuzzy mold spreading on the wall behind the clothes. It’s been getting worse over the last month since the humidity really kicked in. Who is responsible for dealing with this and the repair – me as the tenant, or is it the building management's duty to fix?

In the UAE, the responsibility for mold remediation stemming from an AC unit is typically dictated by the lease agreement and Dubai Law No. 26 of 2007, known as the 'Regulating Relationship between Landlords and Tenants in the Emirate of Dubai Law'. The general principle is that the landlord is responsible for the maintenance of the main structure of the property and its core systems, which includes the central air conditioning system and the building's waterproofing. The tenant is usually responsible for minor internal maintenance and keeping the property clean.

The AC leakage you describe is a failure of the system itself, likely a blocked condensate drain line—a very common issue in Dubai's high-humidity climate where AC units run year-round and produce significant condensation. This mechanical failure, which has led to water intrusion and subsequent black mold growth on the structural wall, is the root cause. Therefore, the responsibility to repair the AC unit, address the water damage, and conduct the necessary mold remediation almost certainly falls on the landlord or building management.

However, you must formally notify them in writing immediately. Delay can exacerbate the problem and potentially lead to disputes about tenant negligence. The black, fuzzy mold you describe indicates a significant moisture issue that requires professional assessment. DIY cleaning is not advised, as improper handling can aerosolize toxic spores. The underlying moisture problem must be solved first.

For a definitive assessment and to ensure the remediation is handled safely and effectively, I strongly recommend a professional inspection. Our team at Saniservice can provide a comprehensive report detailing the cause, extent of contamination, and a scope of remedial works, which can be used to formally liaise with your property management.
