Is landlord responsible for mold inspection and doctor bills?« Back to Previous Page

My kids have been coughing and I suspect it’s from the black mold that’s been spreading along the ceiling in our master bedroom closet. We’ve lived here for 2 years and just noticed it, but it must have been growing since last winter's humidity. Who is responsible for the inspection and remediation, me or the landlord, and should I be asking them to cover our doctor's visits?

Based on the UAE Civil Code, particularly Federal Law No. (5) of 1985, a landlord is legally obligated to provide a habitable property that is free from defects affecting its intended use. The presence of widespread black mold (Stachybotrys chartarum), which you suspect is causing health issues, constitutes a significant habitability issue. Therefore, the responsibility for inspection and remediation falls squarely on the landlord. You must formally notify them in writing of the issue and request immediate professional assessment and remediation.
Given your children's symptoms and the mold's location, a professional inspection is non-negotiable. The Dubai climate, with its high humidity and constant AC use, creates perfect conditions for mold growth inside wall cavities and on cold surfaces like AC ducts and closet ceilings, often from condensation issues. DIY assessments are insufficient as they miss hidden contamination and fail to identify the moisture source. Regarding doctor's bills, while the landlord is responsible for fixing the property, establishing direct legal liability for medical expenses is more complex and would require a physician to formally link the illness directly to the mold exposure in your specific home. You should, however, absolutely inform the landlord of the health impact as it underscores the urgency. For a definitive resolution, I recommend engaging a certified professional. Our team at Saniservice conducts comprehensive inspections, including moisture mapping and air quality testing, to provide a detailed report for your landlord. We can then execute the necessary containment, removal, and hygienization to ensure the environment is safe.
