Who is responsible for mold repair cost, tenant or landlord?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for 2 years and just noticed a big patch of black mold in the corner of our master bedroom closet, behind some boxes. It must have been growing for ages. I'm worried it's from a hidden leak in the wall or something. Who is responsible for dealing with this and the cost of repairs, me as the tenant or my landlord?

In the UAE, specifically Dubai, responsibility for mold remediation costs is typically determined by the source of the moisture problem, as outlined in standard tenancy contract clauses and the Dubai Rental Law.

As a certified mold inspector, the first step is always a professional inspection to identify the causative factor. If the mold growth in your JVC apartment is a result of a structural issue, such as a concealed leak in the building's plumbing, a faulty AC condensation drain line within the walls, or water ingress from external cracks or poor sealing, the financial responsibility for both the repair of the leak and the subsequent mold remediation falls upon the landlord. They are obligated to provide a habitable property under the law.

However, tenant liability may apply if the cause is determined to be due to occupant behavior. In Dubai's humid climate, this includes chronic failure to use the AC for humidity control, obstructing ventilation grilles, or creating excessive moisture through activities like drying clothes indoors without adequate ventilation. The presence of boxes pushed against the wall, as you described, can severely restrict airflow and create a microclimate perfect for condensation and mold growth, which a landlord could argue is tenant-induced.

Given the location and size you describe, a hidden leak is a strong possibility. We strongly recommend you immediately contact your landlord and request a professional mold inspection. DIY attempts can disturb toxic spores and fail to address the root cause. Our team at Saniservice uses thermal imaging cameras and moisture meters to pinpoint the exact moisture source without destructive exploration. We provide a detailed report that can be used to definitively establish liability.
