Who handles and pays for mold removal in a rental?« Back to Previous Page

Our bedroom closet in our Deira apartment has a patch of black mold that we just found behind some boxes. It's been getting worse since the heavy humidity a few weeks back, and the musty smell is really strong in that room now. Who is supposed to handle this and pay for it, me as the tenant or the landlord, and what's the best way to get it properly cleaned?

In the UAE, the responsibility for mold remediation in a rental property is determined by the cause of the moisture, as outlined in Dubai Law No. 26 of 2007 (Amended by Law No. 33 of 2008) Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai. The landlord is responsible for addressing structural issues that lead to mold, such as leaks in the building envelope, faulty plumbing, or inadequate waterproofing. However, if the tenant's actions are the primary cause—such as poor ventilation, failing to use the AC appropriately to control humidity, or blocking airflow with stored items—the financial responsibility for remediation falls to the tenant.

The high humidity and condensation common in Dubai's climate, especially during summer, require year-round air conditioning to manage indoor moisture levels. A closet in Deira with a musty odor and visible growth indicates a significant humidity problem, likely exacerbated by restricted airflow from boxes placed against the wall.

Given the strong smell and visible patch, this is a serious case requiring professional assessment. DIY cleaning with bleach is ineffective and can exacerbate spore dispersal. A certified inspector must identify the exact moisture source and mold type to determine liability and the correct remediation protocol. This involves moisture mapping, air and surface sampling, and a detailed report.
