Who is responsible for mold in a Dubai rental?« Back to Previous Page

We've lived in our Jumeirah Village Triangle apartment for 2 years and just noticed a bunch of black spots spreading along the corner of our bedroom wall, right behind the wardrobe. It’s gotten worse since the humidity spiked last month. I’ve told the landlord, but they’re saying it’s our fault for not ventilating the room properly. Who is actually responsible for getting this cleaned and treated, the tenant or the owner?

Based on the Dubai Rental Law (Law No. 26 of 2007) and subsequent regulations, the responsibility for mold remediation in a rental property is determined by the root cause of the moisture issue.
The landlord is responsible for addressing structural or maintenance-related defects that lead to mold growth. This includes, but is not limited to, leaking pipes within the walls, faulty air conditioning systems that do not dehumidify properly, cracks in the building envelope allowing water ingress, or rising damp from a failed damp proof course. These are considered failures of the property's core infrastructure, which the owner is obligated to maintain in a habitable condition. The tenant, however, is responsible for damage resulting from negligence or failure to maintain the property in a hygienic state. In Dubai's humid climate, this primarily means failing to adequately ventilate the property to manage condensation. If the mold is localized to an area with poor air circulation (like behind a large piece of furniture) and there is no evidence of a structural leak, the tenant may be held liable for the cleanup. The tenant's duty is to use the property in a way that does not cause preventable damage. Given your situation in Jumeirah Village Triangle, the proximity to the wardrobe suggests a classic case of condensation due to restricted airflow, exacerbated by our high humidity. However, a professional inspection is critical to rule out a hidden leak from the AC condensation line or the external wall. This forensic investigation will definitively assign responsibility. For an authoritative assessment and to resolve the dispute with your landlord, I strongly recommend a certified mold inspection. Our team at Saniservice can identify the exact moisture source, provide a detailed report for your landlord, and perform the necessary remediation.
