AC leak causing mold: landlord or tenant responsibility?« Back to Previous Page

The AC in my apartment in Jumeirah Village Circle has been leaking a bit onto the carpet in the living room for a couple of months. Now, I'm starting to see black spots spreading out from the corner where the water pools, and the smell is getting really strong. Who is responsible for getting this tested and fixed – me or my landlord?

In the UAE, landlord-tenant responsibilities for mold caused by AC leaks are clearly defined under Law No. (26) of 2007, known as the Dubai Rental Law. The responsibility for structural maintenance, including the repair of the central AC system and any resultant damage to the property, falls squarely on the landlord. Since the AC leak is the root cause of the moisture intrusion leading to the microbial growth, your landlord is legally obligated to address both the leak and the resultant damage.

However, as the tenant, you have a duty to report the issue promptly. Given that the leak has been ongoing for months, you must formally notify your landlord or property management company in writing immediately to avoid any potential disputes over negligence. The conditions you describe – black sporulating colonies and a strong, musty odor – indicate an active and likely significant infestation. In Dubai's high-humidity climate, this situation will rapidly deteriorate. The carpet and underlying padding are probable reservoirs of contamination and will likely require professional removal and disposal.

This is not a minor issue. The spreading mold poses a health risk and can cause further damage to the building structure. We strongly recommend you insist on a professional mold inspection to assess the full extent of the contamination, including any potential growth within the AC unit itself or the wall cavity. Do not attempt to clean this yourself, as improper handling can aerosolize toxic spores throughout your apartment.
