Is landlord responsible for AC leak and mold removal?« Back to Previous Page

The AC in my bedroom in my Jumeirah Village Triangle apartment seems to be leaking, and now there's a large patch of black mold spreading on the wall behind the wardrobe. It’s been getting worse for a couple of weeks and I'm worried about our health. Is the landlord responsible for the mold removal and fixing the AC, or is this on me as the tenant to handle?

Based on UAE rental law, specifically Law No. (26) of 2007, the landlord is typically responsible for the maintenance of the property's main structural components and essential services, which includes the central air conditioning system. An AC unit leaking inside the apartment falls under this category, as it is a fundamental utility. The resulting mold growth is a direct consequence of this failure in the building's infrastructure.

Given the climate in Dubai, with its high humidity and year-round reliance on AC, condensation issues are a primary cause of microbial growth. A large, spreading patch of black mold indicates a significant moisture problem that requires immediate professional attention. Attempting to clean it yourself is not advisable, as improper remediation can aerosolize spores and worsen contamination throughout your living space.

Your first step should be to formally notify your landlord or property management company in writing about the AC leak and the subsequent mold damage, requesting immediate remediation. They are obligated to address the source of the leak and the resultant damage to make the property habitable.

For a situation of this severity, we strongly recommend a professional assessment. Our certified inspectors at Saniservice can conduct a comprehensive investigation to determine the full extent of the mold contamination, identify the precise moisture source, and provide a detailed report that can be used to ensure the landlord completes the repairs and remediation to a proper standard.
