Am I or my landlord responsible for mold removal?« Back to Previous Page

My kids have been coughing and I suspect it's because of the black mold I just found behind the wardrobe in our master bedroom. We've been in this JVC villa for about a year and this is the first time we've pulled the furniture away from the wall. The dehumidifier runs constantly but the wall still feels damp. Am I responsible for hiring and paying for the mold removal, or is this something I need to get my landlord to handle?

In the UAE, the responsibility for mold removal is primarily dictated by the tenancy contract and the cause of the moisture. Under Dubai Law No. 26 of 2007 (as amended), the landlord is responsible for maintaining the property's structural integrity. If the dampness and subsequent mold growth are due to a structural defect, such as a leaking pipe within the wall, a faulty AC drain line, or water seepage from the building envelope, the landlord is legally obligated to address the repair and the resulting mold remediation.

However, tenant responsibilities include maintaining adequate ventilation to prevent condensation, a common issue in Dubai's humid climate exacerbated by year-round AC use. If the mold is solely due to tenant behavior—like failing to use exhaust fans, drying clothes indoors, or blocking AC vents with furniture—the cost of remediation may fall to you. The presence of a dehumidifier running constantly suggests a significant, persistent humidity problem that likely points to an underlying structural or mechanical issue.

Given that you've discovered black mold (likely Stachybotrys chartarum) and your children are exhibiting respiratory symptoms, this is a serious health concern that requires immediate professional assessment. Do not attempt to remove it yourself, as improper handling can aerosolize toxins and worsen the situation.

We strongly recommend you contact your landlord immediately, document the issue with photos, and formally request a professional mold inspection. Our certified team at Saniservice can conduct a comprehensive assessment to identify the exact moisture source and species of mold, providing a definitive report to determine liability.
