Is landlord responsible for black mold from AC leak?« Back to Previous Page

The AC in my bedroom closet has been leaking on and off for months, and now I've found a huge patch of black mold spreading on the back wall and my shoes. I told the building maintenance about the leak but they were slow to fix it. Is the landlord responsible for cleaning this up and fixing the damage, or is this on me since I didn't notice it right away?

In the UAE, specifically under Dubai Law No. 26 of 2007 (as amended) regulating the relationship between landlords and tenants, the landlord is unequivocally responsible for maintaining the property's structure and essential services, including the central air conditioning system and its components. An AC leak that leads to mold growth is a maintenance issue stemming from the building's core systems. Therefore, the landlord is legally obligated to not only repair the leak but also to remediate the resulting mold damage and any subsequent property damage, such as to the wall.
However, the tenant has a responsibility to report issues in a timely manner. While you did inform building maintenance, the prolonged nature of the leak complicates matters. The "black mold" you describe is a serious concern. In Dubai's high-humidity climate, AC units are critical for controlling moisture. A persistent leak creates a perfect environment for toxic molds like Stachybotrys chartarum to proliferate, posing significant health risks and compromising structural integrity. This is not a situation for DIY cleaning. Disturbing the mold can aerosolize toxic spores throughout your living space. The remediation process requires professional containment, HEPA filtration, antimicrobial treatment, and addressing the root moisture source. You must formally notify your landlord in writing of the issue, referencing the existing maintenance reports. We strongly recommend a professional mold inspection to document the extent of contamination for your records and to ensure the remediation is handled correctly.
