Is black mold from AC leak landlord's responsibility?« Back to Previous Page

The AC in my apartment seems to be leaking a little bit of water onto the wall behind it in the living room. I wiped it up but didn't think much of it, and now a big black mold patch has appeared there over the last couple of weeks. My lease says I'm responsible for minor maintenance, but this feels like it's getting out of hand. Is this kind of mold remediation the tenant's or the landlord's responsibility to fix?

Based on the Dubai Landlord and Tenant Law (Law No. 26 of 2007) and its amendments, the responsibility for this type of mold remediation is typically the landlord's. The law stipulates that the landlord is responsible for maintaining the property's structure and its key mechanical systems, which includes the central air conditioning unit and its associated drainage lines. The recurring water leakage from the AC is a structural/systemic issue, not a minor maintenance item like changing a lightbulb. The resulting black mold (Stachybotrys chartarum) is a direct consequence of that unchecked moisture intrusion.

The UAE's high humidity and year-round AC use create a perfect environment for rapid mold proliferation from any minor leak. What starts as a small drip can lead to significant microbial growth within the wall cavity in a matter of days.

However, you must formally notify your landlord or property management company in writing about the issue immediately. Provide clear photos of the leak source and the mold growth. This documents the problem and starts the clock on their obligation to rectify it. Do not attempt to remove this yourself, as improper remediation can aerosolize toxic spores and spread the contamination.

For a definitive assessment and to ensure the landlord addresses it correctly, we recommend a professional inspection. Our certified technicians at Saniservice can conduct a thorough investigation, provide a detailed report on the extent of the infestation and the required remediation protocol—a document that is invaluable for liaising with your landlord.
