Is mold inspection a tenant or landlord responsibility?« Back to Previous Page

We've lived in our Jumeirah Village apartment for two years and just noticed a large patch of black mold in the corner of our master bedroom closet, behind some storage boxes. The building's AC is always running and I'm worried the humidity is causing it. With the recent humidity, the musty smell in the whole room has gotten worse. As a tenant, am I responsible for paying for a professional mold inspection, or is that the landlord's duty?

In the UAE, the responsibility for mold inspection and remediation is primarily governed by the rental contract and Law No. 26 of 2007, known as the Dubai Rental Law. Typically, the landlord is responsible for maintaining the structural integrity of the property and addressing issues arising from inherent building defects, such as faulty AC systems, leaking pipes in walls, or inadequate waterproofing that leads to condensation and mold growth. The climate in Dubai, with its extreme humidity and reliance on year-round air conditioning, often exacerbates these underlying issues if the building's envelope or HVAC system is not properly maintained.
As a tenant, you are responsible for reporting the issue promptly and for any damage resulting from your own negligence, such as failing to use the AC properly or blocking ventilation. The mold behind your boxes in Jumeirah Village, however, is likely due to a condensation issue from the constantly running AC unit, which is a building system. The worsening musty smell indicates an active problem that requires professional assessment. I strongly recommend you formally notify your landlord or property management company in writing immediately. A professional mold inspection is crucial to determine the source of the moisture—whether it's a leaking pipe, AC drain pan overflow, or inadequate insulation. DIY assessments are insufficient as they miss hidden contamination. For a comprehensive inspection involving moisture mapping and air quality testing, contact our specialists at Saniservice.
