Who is responsible for mold removal in a rental?« Back to Previous Page

The wall behind our wardrobe in the bedroom has a huge patch of black mold, and it’s definitely been spreading since the humidity kicked in a few weeks ago. We’re in a rented apartment in Jumeirah and our contract says the landlord is responsible for maintenance, but I’m not sure if this counts. Who is legally obligated to handle and pay for the mold removal, us or the property owner?

In the UAE, specifically Dubai, the responsibility for mold remediation in a rental property is typically determined by the cause of the moisture intrusion, as outlined in Law No. 26 of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai (as amended).
The landlord is generally responsible for addressing structural issues that lead to mold growth. This includes problems like leaking pipes within the walls, faulty waterproofing on the building's exterior, or defective air conditioning systems that cause excessive condensation. The landlord's obligation is to provide a habitable property, and persistent mold from a structural defect violates this. However, tenant responsibility arises if the mold is a direct result of their negligence or lifestyle. This includes failure to use the AC adequately to control humidity, obstructing ventilation, improper drying of wet clothes indoors, or failing to report a minor leak in a timely manner, allowing it to develop into a major mold problem. Given your situation—a large patch spreading behind a wardrobe in Jumeirah, a high-humidity coastal area—the cause is likely poor external wall insulation or internal condensation from AC unit drip pans or ductwork, which are structural and the landlord's responsibility. You must formally notify your landlord/property manager in writing immediately. We strongly recommend a professional inspection first to definitively identify the moisture source and extent of contamination. Our certified experts at Saniservice use thermal imaging and moisture meters to provide a conclusive report, which is crucial for liaising with your landlord. For immediate assistance, please call us at 800-MOLDS or email hello@saniservice.com to schedule a diagnostic assessment. Do not attempt removal yourself, as improper handling can aerosolize toxic spores and exacerbate the health risk and property damage. |
