Is black mold in bathroom landlord's responsibility?« Back to Previous Page

We’ve been in our Jumeirah Village Circle apartment for a year and just noticed a bunch of black mold spreading along the ceiling and in the corners of our master bathroom. The humidity has been brutal lately and the bathroom vent doesn’t seem to be pulling any steam out. Are we responsible for cleaning this ourselves, or is this the landlord's job to fix since the ventilation might be faulty?

In the UAE, particularly in humid climates like Dubai, black mold in bathrooms is a common issue due to high condensation levels and year-round AC operation. The responsibility for remediation hinges on the cause. Under standard Dubai rental law (Law No. 26 of 2007), landlords are responsible for maintaining the structural integrity and essential systems of the property. This includes the functionality of installed ventilation systems.

If the mold growth is a direct result of a faulty exhaust fan that is not extracting moisture, this constitutes a failure of a provided fixture. Therefore, the landlord is typically obligated to repair or replace the ventilation unit. However, the tenant is responsible for general upkeep and daily ventilation practices, such as running the fan during and after showers and wiping down wet surfaces.

Given the description of significant spreading on the ceiling, this indicates a persistent moisture issue that requires professional attention. We strongly recommend against self-cleaning with bleach, as this only addresses surface discoloration and not the underlying moisture problem or the root mold colony. Improper handling can aerosolize spores, worsening contamination.

A certified mold inspection is crucial to identify the exact species (e.g., Stachybotrys chartarum, or common mildew) and the precise source of moisture—whether it's solely due to the faulty vent or potentially a hidden leak. This professional report will definitively outline liability and the required scope of remediation.
