Is landlord responsible for AC leak mold in JVC apartment?« Back to Previous Page

The AC in my bedroom has been leaking a little, and now I've found a patch of black mold on the back of the wardrobe that's against the wall. It's been slowly getting bigger over the last few weeks. I'm renting an apartment in Jumeirah Village Circle and I'm worried about my health and the damage to my furniture. Am I responsible for cleaning this myself, or is my landlord required to handle and pay for the professional mold removal?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the responsibility for maintaining the structural integrity of the rented property, including the fixed air conditioning system and the building envelope, falls upon the landlord. An AC leak that leads to mold growth is a maintenance issue directly related to the provided fixture. Therefore, your landlord is legally obligated to address the source of the leak and the resultant mold contamination to ensure the property is habitable and safe.

The persistent humidity in Dubai, combined with condensation from a faulty AC unit, creates a perfect environment for mold proliferation, especially in concealed areas like behind furniture. The black patch you describe indicates an active moisture problem. Attempting to clean this yourself is not advised. Surface cleaning with household products will not address the root cause (the leak) or the hyphal fragments that have likely penetrated the porous material of the wardrobe and possibly the wall itself. Inadequate remediation can aerosolize spores, increasing your exposure and health risks.

You should immediately notify your landlord in writing, detailing the issue and requesting professional remediation. For a case like this, a professional inspection is critical. A certified mold assessor can determine the full extent of the contamination, identify the precise moisture source, and prescribe the correct remediation protocol, which may involve controlled removal of affected materials, HEPA vacuuming, and antimicrobial application.

For expert assessment and certified mold remediation services in Dubai, I recommend contacting Saniservice. Their technicians are trained to handle such situations in accordance with industry standards and can provide the documentation your landlord may require.
