The AC in our bedroom closet has been leaking for a while, and now I've found a huge patch of black mold spreading on the back wall and our stored clothes. We've been in this Jumeirah Village Circle apartment for over a year and the landlord is saying it's our fault for not maintaining the AC unit. Who is legally responsible for fixing the leak and the mold remediation in a rental here?

Based on UAE Civil Code and Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai (the 'Dubai Rental Law'), the responsibility is typically determined by the source of the fault.

The landlord is legally obligated to maintain the property's structure and ensure it is habitable. This includes the main building systems, such as the central AC unit, its internal ducting, and the drainage pipes (condensate lines) that are part of the building's infrastructure. If the leak originates from a faulty installation, a cracked drain pan within the wall, or a blocked main condensate pipe, the repair and subsequent mold remediation are unequivocally the landlord's financial and legal responsibility.

However, tenant responsibility arises from negligence. If the leak is due to a lack of maintenance on the AC unit's filter that you are required to clean regularly, or damage you caused, you could be held liable. The landlord's argument hinges on this point.

Given the climate in Dubai, where AC systems run year-round and high humidity accelerates mold growth, immediate professional action is critical. Black mold indicates a significant, long-term moisture issue.
