Is landlord responsible for shower mold causing cough?« Back to Previous Page

My kids have been coughing and I suspect it might be from the black mold that's been spreading along the ceiling above our shower in Silicon Oasis. We've lived here for 2 years and just noticed it getting really bad over this last humid season. Who is responsible for handling this and the potential health issues, me as the tenant or the landlord?

Based on UAE tenancy law, specifically Law No. (26) of 2007, landlords are generally responsible for maintaining the structural integrity of the property. This includes addressing issues arising from inherent building defects, such as faulty waterproofing, poor ventilation, or leaking internal plumbing that leads to mold growth. If the black mold along your shower ceiling in Silicon Oasis is a result of such a structural issue, the landlord is obligated to rectify it.
However, the high humidity and constant condensation from showering, combined with our year-round reliance on AC which can create temperature differentials, are primary catalysts for mold. Tenant responsibilities typically include maintaining adequate ventilation during and after showers to mitigate this moisture. The recent humid season would have significantly exacerbated the situation. The coughing experienced by your children is a serious indicator of potential health impacts from mold spore exposure. Black mold (often Stachybotrys chartarum) can produce mycotoxins that cause respiratory irritation. This necessitates immediate professional attention. I strongly recommend a certified mold inspection to determine the root cause. Our specialists at Saniservice can conduct a comprehensive assessment, including air quality testing to identify spore types and concentrations. This report is crucial as it will definitively establish liability. If the cause is structural, we can provide the documentation required for your landlord. For your family's health, do not attempt to remove significant mold growth yourself, as improper remediation can aerosolize spores and worsen the problem.
