Is landlord responsible for mold from AC leak?« Back to Previous Page

The AC in my bedroom closet has been leaking on and off for months, and now we're seeing black spots spreading on the wall and our stored clothes. My toddler has had a persistent cough for the last few weeks that just won't clear up, and I'm getting really worried. Our landlord says it's just humidity and to run the AC more, but I feel like it's a health hazard. Who is legally responsible for fixing the mold issue and the AC leak in a rental here – is it the landlord, or is it on me to handle it?

Based on the symptoms you've described, specifically the black spots and your toddler's persistent cough, you are likely dealing with a significant mold infestation that constitutes a genuine health hazard. The persistent moisture from the AC leak provides the perfect environment for mold growth, which is a common issue in Dubai's humid climate where AC systems run year-round and condensation problems are frequent.

Under UAE tenancy law, specifically Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai, the landlord is unequivocally responsible for maintaining the property's structural integrity and ensuring it is habitable. This includes the maintenance and repair of all central fixtures like the air conditioning system. The AC leak is a structural maintenance issue, and the resulting mold is a direct consequence of their failure to address it. Simply advising you to "run the AC more" is not an acceptable remedy and neglects their legal obligation.

For the health of your family, especially your toddler who is particularly vulnerable to mold spores causing respiratory issues like coughing, this situation requires immediate professional attention. Do not attempt to clean this yourself, as improper handling can aerosolize the spores and exacerbate the health problems.

We strongly recommend you formally request in writing that the landlord arranges for a professional mold inspection and remediation immediately. For a definitive assessment and to document the issue, you can engage a certified environmental inspector. Our team at Saniservice can provide a comprehensive inspection and lab analysis to identify the mold species and the full extent of the contamination, which can be crucial for dealing with your landlord.
