Who is responsible for AC leak and mold, landlord or tenant?« Back to Previous Page

The AC in my bedroom in Jumeirah Village Circle has been leaking a little, and now I’ve found a patch of black mold on the wall behind the wardrobe. My landlord is saying it’s from our AC usage and we should clean it, but we run it constantly like everyone else here. Who is actually responsible for fixing the leak and treating the mold in a rental, the tenant or the landlord?

Based on the UAE Civil Code and standard tenancy contract terms, the responsibility for fixing the AC leak and the subsequent mold remediation is almost always the landlord's. The AC unit is a fundamental part of the property's provided fixtures, and its maintenance to ensure it is in good working order falls under the landlord's obligation to deliver the property in a habitable condition.
The leak itself is a mechanical or drainage issue that requires a qualified HVAC technician to address. The resulting mold growth, however, is a separate and more serious environmental health issue. The humid climate of Dubai, especially in areas like JVC, creates a perfect environment for mold to proliferate from any water source. While tenant behavior (like setting the AC too cold, leading to excess condensation) can be a contributing factor, the root cause is the leak. Merely cleaning the visible patch is insufficient; the moisture source must be eliminated, and the mold must be properly remediated to prevent regrowth and potential health impacts from mycotoxins. We strongly recommend you stop using that AC unit and request in writing that your landlord arrange for a professional inspection. A certified mold inspector can identify the exact species (e.g., is it the notorious Stachybotrys chartarum?) and the full extent of the contamination, which often spreads behind walls. This report will definitively establish liability and the required scope of work.
