Is black mold from AC leak my responsibility?« Back to Previous Page
|
The AC in my bedroom has been leaking a bit onto the carpet for a couple of months, and now I've found a patch of black mold growing behind the nightstand. My landlord is saying it's because I don't run the AC cold enough, but I keep it at 23. Am I responsible for fixing the AC unit and cleaning this up, or is this the landlord's job?

Based on the UAE Civil Code and common tenancy law (Law No. 26 of 2007), the responsibility for maintenance of major building systems, including the central AC unit and its condensate drainage lines, typically falls on the landlord. The leak itself is a maintenance issue that the property owner must address. The resulting mold growth is a direct consequence of that unresolved leak.
Your AC setting of 23°C is not the cause. In Dubai's high humidity climate, AC systems are designed to manage condensation effectively. A leak indicates a blockage in the drain line, a faulty drain pan, or improper installation/insulation – all inherent to the unit's condition. While tenants are responsible for general cleanliness, mold caused by a structural or mechanical defect is the landlord's responsibility to remediate. However, this is a serious health and property issue. Black mold (likely Stachybotrys chartarum or Aspergillus niger) can cause significant respiratory problems and degrade building materials. Do not attempt to clean it yourself with bleach, as this can aerosolize spores and only removes surface discoloration, not the root colonization. We strongly recommend you immediately contact your landlord in writing, insisting they arrange for a professional mold inspection and remediation. The underlying moisture source must be fixed first. For a proper assessment and a legally defensible report on the mold's extent and cause, our certified experts at Saniservice can provide a comprehensive inspection. We use thermal imaging to detect hidden moisture and air sampling to identify spore types and concentrations.
