Who is responsible for mold in a Dubai rental?« Back to Previous Page

We've lived here for 2 years and just noticed a big patch of black mold spreading on the wall behind our bedroom wardrobe, which feels damp to the touch. It probably started after the heavy humidity a couple of months ago. Our tenancy contract is a bit vague on this, so I'm not sure if this is something I need to fix myself or if I should contact my landlord in Jumeirah to handle it. Who is legally responsible for mold remediation in a rental, the tenant or the property owner?

In the UAE, the responsibility for mold remediation in a rental property is typically determined by the cause of the moisture intrusion, as outlined in Dubai Law No. 26 of 2007, amended by Law No. 33 of 2008 (the 'Dubai Rental Law'). The landlord is legally obligated to provide a habitable property and maintain the structural integrity of the building. Therefore, if the mold is a result of a structural defect, such as a leaking pipe within the wall, a faulty AC system causing condensation, or water seepage from the building envelope, the financial and remedial responsibility falls squarely on the landlord.
However, the tenant is responsible for damages resulting from negligence or misuse. In your case, the location behind a wardrobe is critical. If the wardrobe was placed flush against the wall, restricting airflow in our high-humidity climate, and you did not perform regular ventilation, a tenant liability argument could be made. The constant year-round AC use can create significant condensation if air circulation is blocked. Given the description—a "big patch" that is "damp to the touch"—this requires immediate professional attention. Do not attempt to clean it yourself, as disturbing extensive mold can exacerbate spore dispersal and health risks. Your first step is to formally notify your landlord in writing, with photos, and request a professional mold inspection. This will definitively identify the moisture source. For a certified inspection and remediation report that clearly establishes causation for your landlord, I recommend contacting our specialists at Saniservice. We provide detailed forensic-level testing to determine the root cause. Call us at 800-MOLDS (800-66537) or email hello@saniservice.com to schedule an assessment. |
