Is the landlord responsible for black mold from AC leak?« Back to Previous Page

The wall behind my wardrobe in the master bedroom has a huge patch of black mold that I just discovered while deep cleaning. We've been in this Al Nahda apartment for over a year, and the AC unit in that room has always dripped a little, but now the whole area feels damp and the paint is peeling. Is getting this fixed the landlord's responsibility, or is it on me because I didn't report the AC drip sooner?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is unequivocally responsible for the structural integrity of the property and the maintenance of all major installed systems, including the central air conditioning unit. The recurring AC drip you've described is a clear maintenance issue that falls under the landlord's obligation to provide a habitable dwelling. The resulting black mold and structural damage to the wall are direct consequences of this unresolved issue.

The persistent humidity and condensation from the AC leak create an ideal environment for mold proliferation, a common issue exacerbated by Dubai's climate. While tenants have a duty to report issues in a timely manner, the fundamental responsibility to rectify the fault and its resultant damage lies with the property owner. Your prior report of the AC drip strengthens your position, as it demonstrates the landlord was aware, or should have been aware, of the condition leading to the damage.

However, due to the extensive nature of the growth you describe ("huge patch"), this is a serious case requiring professional intervention. Do not attempt to clean this yourself, as improper handling can aerosolize toxic spores and spread contamination. A certified mold inspection is critical to assess the full extent of the infestation, identify the exact species (e.g., Stachybotrys chartarum), and create a scope for proper remediation.

We strongly recommend you formally notify your landlord in writing immediately and request a professional mold assessment.
