The AC in our bedroom has been leaking a bit and now we’ve discovered a patch of black mold on the wall behind the wardrobe. It’s been humid for the last couple of months and it’s definitely gotten worse. Who is responsible for fixing this and the cost of cleaning – is it me as the tenant or is it the landlord's problem?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is typically responsible for the maintenance of the property's main structure and essential systems, which includes the central air conditioning unit and the building envelope. An AC leak that leads to mold growth falls squarely under this category of structural maintenance.

The key factor is establishing the cause. As the tenant, you are responsible for informing the landlord or property management company of the issue in writing as soon as it is discovered. This notification is crucial. Failure to report it promptly could potentially make you liable for exacerbating the damage. The landlord is then obligated to address the root cause—fixing the AC leak and any resulting water damage. The remediation of the mold itself, which is a direct consequence of their maintenance responsibility, should also be covered by the landlord.

However, given that this is black mold (Stachybotrys chartarum or similar), a professional assessment is non-negotiable. In Dubai's high humidity, what is visible is often just the tip of the iceberg. Spores can spread behind walls and into the AC ductwork, creating an indoor air quality hazard and a more extensive remediation project. DIY cleaning is not advised for black mold, as improper handling can aerosolize toxins and contaminate the entire room.
