Who is responsible for black mold in a Dubai rental?« Back to Previous Page

My kids have been coughing and I suspect it’s from the black mold that’s been spreading along the bottom of the bedroom wall. We’ve lived here for 2 years and just noticed it when we moved the dresser after the last humid spell. I’ve told the landlord, but he says it’s our fault for not ventilating the room properly. Who is legally responsible for the inspection and cleanup of black mold in a rental apartment here in Dubai?

In Dubai, the responsibility for black mold remediation in a rental property is primarily governed by the rental contract and Dubai Law No. 26 of 2007, known as the 'Real Estate Regulatory Agency (RERA)' law. Typically, the landlord is legally obligated to provide a habitable property free from defects that affect its intended use. Structural issues leading to moisture intrusion, such as leaking pipes, faulty waterproofing, or inadequate external sealing, are unequivocally the landlord's responsibility to rectify.

However, the landlord's argument regarding ventilation is not entirely without merit, given Dubai's extreme humidity and the constant use of AC, which can lead to condensation. Tenants have a duty to maintain the property in a reasonable manner, which includes adequate ventilation to prevent moisture buildup. The key is determining the root cause. If the mold is a result of tenant behavior (e.g., consistently blocking AC vents, failing to use exhaust fans, drying clothes indoors), the tenant may be liable. If it is due to a structural defect or a faulty AC system, the landlord is responsible.

Given your children's health symptoms, this is a serious matter that requires immediate professional assessment. A certified mold inspection is crucial to identify the moisture source and type of mold. Do not attempt to clean significant Stachybotrys (black mold) growth yourself, as improper handling can exacerbate spore dispersal.

I strongly recommend you contact our team at Saniservice for a comprehensive inspection. Our certified experts use moisture meters, thermal imaging, and air quality tests to provide an irrefutable report on the cause, which is essential for resolving liability with your landlord.
