Is landlord responsible for black mold in Dubai rental?« Back to Previous Page

My kids have been coughing for a couple of weeks and I suspect it's from the black mold I just found growing along the bottom of the wall behind our bedroom wardrobe in Silicon Oasis. We've been running the AC constantly to combat the humidity. Is the landlord legally required to handle this and pay for the remediation, or is cleaning it myself my responsibility as the tenant?

In the UAE, the responsibility for mold remediation in a rental property is primarily governed by the rental contract and Dubai Law No. 26 of 2007, as amended (the 'Dubai Rental Law'). Typically, the landlord is responsible for maintaining the structural integrity of the property. This includes addressing the root cause of the mold, which is almost always excess moisture.

The scenario you describe—mold behind a wardrobe in Silicon Oasis with constant AC use—is extremely common here. The root cause is likely a combination of high ambient humidity and cold spots created by the AC, leading to condensation on walls, especially behind large furniture that restricts airflow. While the tenant is responsible for general cleanliness and ensuring proper ventilation, the underlying issue of excessive moisture infiltration or inadequate property waterproofing is a structural/maintenance issue falling on the landlord.

However, we strongly advise against cleaning it yourself. Disturbing black mold (Stachybotrys chartarum) without proper containment and PPE can aerosolize potent mycotoxins, significantly exacerbating your family's respiratory issues, as evidenced by your children's persistent cough. DIY cleaning also only addresses the visible growth, not the hidden moisture source, guaranteeing rapid regrowth.

Your first step is to formally notify your landlord in writing about the issue, citing your health concerns. We highly recommend you engage a professional mold inspection company like Saniservice first. A certified inspector will conduct air and surface sampling to identify the mold species and spore concentration levels, providing an official report that definitively links the problem to the building's condition. This objective evidence is crucial for legally compelling the landlord to act and pay for the necessary professional remediation, which involves identifying and correcting the moisture source, then safely removing the contaminated materials.
