Is landlord responsible for black mold cleanup in rental?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold I've just found growing behind the wardrobe in our master bedroom. We've lived here for 2 years and just noticed it when moving the furniture, and it's been extra humid in Deira this winter. Is the landlord responsible for the cleanup and the repainting, or is this on me?

Based on UAE Civil Code and Dubai Rental Law, the responsibility for black mold remediation in a rental property is typically divided between tenant and landlord, hinging on the source of the moisture.

The landlord is legally obligated to provide a habitable property and maintain the structural integrity of the building. Therefore, if the mold growth is a direct result of a structural defect—such as a leaking pipe within the walls, a faulty AC drainage system, cracks in the external facade allowing water ingress, or inadequate waterproofing—the responsibility for the investigation, mold cleanup, and subsequent repairs (including repainting) falls squarely on the landlord. You must formally notify them in writing of the issue immediately.

However, tenant liability comes into play if the moisture source is due to your lifestyle. In Dubai's high-humidity climate, especially in areas like Deira, activities like drying clothes indoors, insufficient use of AC for dehumidification, or failing to use exhaust fans can lead to condensation, which promotes mold growth behind large furniture like wardrobes. In such cases, the cost of remediation may be your responsibility.

Given that your children are experiencing respiratory symptoms, this is a serious health concern that necessitates a professional assessment. DIY removal is not advised for health and identification reasons. A certified mold inspector can conduct air and surface sampling to identify the species (to confirm it is indeed the problematic Stachybotrys, or "black mold") and, crucially, use tools like thermal imaging and moisture meters to pinpoint the exact moisture source. This professional report is vital evidence to determine liability with your landlord.
