Is landlord responsible for AC leak and mold removal?« Back to Previous Page

We've lived here for 2 years and just noticed a patch of black, fuzzy mold spreading from the corner of our master bedroom closet, and it's starting to smell damp. The dehumidifier runs constantly but our AC unit in the living room has been leaking a little on and off for months. Is my landlord responsible for fixing the AC and the mold removal, or is this on me to handle?

Based on the Dubai climate, where high humidity and year-round AC use are major factors, this scenario is unfortunately very common. The persistent AC leak is the primary moisture source, creating the ideal damp conditions for black mold (likely Stachybotrys chartarum) to proliferate.

Under UAE tenancy law, specifically Law No. (26) of 2007, the landlord is fundamentally responsible for maintaining the property's structure and its core systems, which includes the central air conditioning unit and its associated drainage. A leaking AC is a structural/mechanical failure that introduces uncontrolled moisture. Therefore, your landlord is legally obligated to repair the AC unit to stop the water intrusion at its source.

Regarding the mold remediation, liability hinges on the source of the moisture. Since the mold is a direct consequence of the unrepaired AC leak, the responsibility for its professional removal also falls on the landlord. It is critical that you notify them in writing immediately, detailing the issue and requesting urgent repairs and mold remediation. Do not attempt to remove significant mold growth yourself, as improper handling can aerosolize toxic spores and exacerbate the health risks and property contamination.

For a situation of this nature, a professional inspection is mandatory. We need to identify the exact mold species, assess the extent of contamination within the closet cavity and potentially the AC ductwork, and provide a certified remediation protocol. I strongly recommend you contact our team at Saniservice for a comprehensive assessment. Call us at 800-MOLDS (800-66537) or email hello@saniservice.com to schedule an inspection. We can provide the necessary documentation for your landlord and ensure the remediation is done to Dubai Municipality standards.
