Who is responsible for wardrobe mold, landlord or tenant?« Back to Previous Page

The back of our bedroom wardrobe has been getting these black spots for a couple of months now, and the damp smell is getting stronger, especially after running the AC all day. We're in an older building in Deira, and our lease is up for renewal soon. Who is responsible for dealing with this, me or the landlord, and should I ask them to fix it before I renew?

Based on the UAE Civil Code and common tenancy contract stipulations, the responsibility for mold in a wardrobe typically falls on the landlord, provided the issue is structural and not due to tenant negligence.

The black spots you describe are almost certainly mold growth, a common issue in Dubai's climate. The high humidity, combined with year-round AC use, creates significant temperature differentials that lead to condensation, especially on cold exterior walls—a prime location for wardrobes. This persistent dampness is the root cause. In an older Deira building, the issue could be exacerbated by insufficient insulation or pre-existing moisture penetration in the wall.

Your first step is to formally notify your landlord or property management company in writing, with photographic evidence. Under typical tenancy laws, the landlord is responsible for rectifying defects in the property's structure, including issues arising from poor insulation or water ingress that lead to dampness and mold.

Crucially, you should absolutely request this is resolved before renewing your lease. A persistent damp smell indicates an active mold colony, which poses potential health risks and can damage your personal belongings. Do not simply paint over it, as this will not address the moisture source.

For a definitive assessment and to ensure your landlord takes appropriate action, we recommend a professional mold inspection. A certified inspector can identify the exact moisture source, species of mold, and provide a detailed remediation protocol. This report will serve as crucial documentation for your landlord.
