Is landlord responsible for black mold removal in Dubai villa?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold I just found behind the wardrobe in our master bedroom. We've lived in this Jumeirah Village Triangle villa for 2 years and just noticed it, probably from the humidity seeping through the wall. Who is responsible for the cleanup and cost—is this something I have to handle myself, or is the landlord supposed to arrange and pay for the remediation?

In the UAE, specifically Dubai, the responsibility for black mold (Stachybotrys chartarum) remediation in a rented villa is primarily governed by the rental contract and Law No. 26 of 2007, known as the Dubai Rental Law. The law stipulates that the landlord is responsible for maintaining the property's structural integrity and ensuring it is habitable. Since the mold you describe behind the wardrobe is likely due to water seepage through the wall, this constitutes a structural issue. Therefore, the landlord is typically obligated to address the root cause (the moisture intrusion) and the resulting damage, which includes professional mold remediation.

However, the tenant is responsible for maintaining the property's cleanliness and ensuring adequate ventilation to prevent condensation, a common issue in Dubai's humid climate exacerbated by year-round AC use. You must formally notify your landlord or property management company in writing about the issue immediately. They should arrange for a professional inspection to determine the moisture source and the extent of contamination.

Attempting removal yourself is highly discouraged. Disturbing black mold without proper containment can aerosolize toxic mycotoxins, significantly worsening air quality and health risks like the respiratory symptoms your children are experiencing. Effective remediation requires identifying and fixing the moisture source, isolating the contaminated area, using HEPA filtration, and properly disposing of affected materials.
