Is landlord responsible for AC-related black mold?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a huge patch of black mold in the corner of our master bedroom closet, hidden behind some boxes. It’s been especially humid the last few months and the AC unit is right on the other side of that wall. Are we responsible for cleaning this and paying for any repairs, or is this something our landlord has to handle?

Based on Dubai's rental regulations and the specific circumstances you've described, the responsibility for addressing this AC-related black mold issue likely falls on your landlord.

The core of the problem you've identified—the AC unit being on the other side of the wall—is critical. In the high-humidity climate of Dubai, AC systems are integral to the property's habitability. They are not just appliances but essential building systems that manage the indoor environment. When an AC unit malfunctions, often due to drainage issues or poor insulation on the cold water lines (a common issue here), it leads to excessive condensation. This moisture accumulation within the wall cavity creates the perfect conditions for the rapid growth of Stachybotrys chartarum (black mold) you are seeing.

Under Dubai Law No. 26 of 2007 (as amended), landlords are responsible for maintaining the property's main structure and essential systems, which includes the central AC system and the building envelope. Since the mold is a direct result of a systemic moisture issue from the AC, it is the landlord's obligation to investigate the source, carry out necessary repairs to the AC unit or wall, and subsequently remediate the mold. Your responsibility as a tenant is typically limited to reporting the issue in a timely manner and allowing access for inspection and repairs.

However, we strongly advise against attempting to clean a "huge patch" yourself. Disturbing significant mold growth can aerosolize toxic spores throughout your apartment. A professional inspection is necessary to determine the full extent of the infestation, identify the precise moisture source, and provide a certified remediation protocol.
